From the Purchaser's Perspective
- You need to know that the searches have been done properly and that there are no adverse interests. There are two aspects
to searches being done properly:
- that the right searches were done;
- that nothing was missed (by the lawyer or responding authority).
- You also need assurance that there is good and marketable title. You need this in order to be able to sell
the property at a future date. This could be provided by a lawyer's opinion or a title insurance policy
(including TitlePLUS title insurance).
- You need to be aware of the importance of recourse and/or source of compensation if a problem emerges. Some of the types
of problems that could lead a purchaser to want compensation are:
- actual title problem (e.g., competing owner);
- adverse financial interest (e.g., old mortgage, tax arrears).
