What is the TitlePLUS Program?

Introduction

TitlePLUS is a Canadian title insurance product offering comprehensive insurance coverage for both title-related aspects of a transaction and the legal services provided by a lawyer. It is also the only title insurance product that covers both you and the borrower under the same policy. With TitlePLUS, purchasers and lenders continue to benefit from the advice and expertise of an independent lawyer who, as before, will conduct the required searches and inquiries and provide advice and guidance on many issues involved in home buying or refinancing.

TitlePLUS insures condominiums, new and resale homes, cottages, rural properties, residential rental properties (up to 4 units), and farms. TitlePLUS is also available for mortgage-only transactions.1

TitlePLUS provides purchasers with the reassurance that their legal interest in the property is protected by insurance for as long as they, or their heirs, own the property. The policy provides protection for the actual financial losses the purchaser and lender may suffer from title defects or the negligence of the lawyer handling the transaction.

TitlePLUS ensures that both the home buyer and lender benefit from the expertise and advice of an independent lawyer in their own community, thus strengthening beneficial local relationships. TitlePLUS lawyers are members of your community and bring that knowledge of the community and local matters to each TitlePLUS transaction. TitlePLUS lawyers can offer your clients a wide range of products and services that enhance the home buying experience — ensuring your clients receive unparalleled personal advice and service. TitlePLUS ensures that lawyers follow the same standard of practice — a standard that protects you and your customer.

TitlePLUS is competitively priced with similar products and services available from other title insurers.

TitlePLUS insures home buyers and lenders directly. If there is a problem with title or the services provided by the lawyer, the insured party makes a claim directly to the title insurer. If the claim is covered under the TitlePLUS policy, the insurer either pays to rectify the problem or compensates the home buyer or lender up to the full amount of the insurance policy. The insurer usually also pays the legal costs of defending the title if the matter ends up in court.

This direct access to a solution is one of the key differences between TitlePLUS and the previous way of closing, in which lawyers provided an opinion on title. Without TitlePLUS, home buyers and lenders might have to negotiate with the lawyer if a title-related problem crops up, or even sue to be compensated. With TitlePLUS, access to a solution is only a phone call away.
